The Joint Contracts Tribunal (JCT), the UK’s leading contract authoring body with more than two-thirds of projects using its contracts, has completed Revision 1 to the JCT05 suite.
Published by Sweet & Maxwell, the revision not only incorporates Amendment 1, published in April to cover changes made in the Construction (Design and Management) Regulations 2007, but also a range of other updates and corrections.
The Minor Works Building Contracts include amendments to the insurance provisions that reflect changes in the insurance market, and also an alteration to the way that the Construction Industry Scheme is dealt with in the contract: it now requires the status of the employer to be identified for the purposes of the legislation, a change which brings it in line with other JCT contracts.
The Design and Build Contract, and other contracts containing provision for sub-contractor collateral warranties, have been amended to deal with purchasers or tenants, funder(s) and employer in one clause. Where a warranty is for the employer, specific reference is made to the recently published Sub-Contractor Collateral Warranty for Employer (SCWa/E). Consequential changes have been made to Part 2 of the Contract Particulars.
